BURGESS (John, #2); born 8/16/1882
at Burgess Creek, Henry, VA; married Florence Bradshaw
Burgess 11/14/1907 at Bevey Hall, Horsepasture, Henry,
VA; Ceremony held at Brides Father's Home. Maid of honor was
John's little sister Posye. The bride's little sister Phoebe
carried the ring. Her brother Royal was best man. Their daughter
Charlotte Biggs believed that Florence met John while teaching
with John's sister Ellen Burgess. Some of their courtship
is described in Florence's diary; died 1944 at Ettrick, VA;
He died of a heart attack. Daughter Cherie came to stay with
him while he was ill before his death. His health improved
and he was renovating Ettrick home for the return of a youth
girl friend. Heart attack occurred after a hard day of painting;
buried 1994 at Sunset Memorial Park, Chester, Chesterfield,
VA.
As of 8/16/1882, he also went by the name of John Abe
Burgess. Began career as farmer helping father (John
Henry) at old home place on Burgess Creek, Henry, VA. Quit
school after 4th grade and was only son to follow father's
farming career. In 1910 his father deeded the old home place
to Abe and Florence with the understanding that they would
care for John Henry and wife Mary. After his Father's death
in 1914, they moved to Ivor, VA where he managed a Norfolk
and Western Farm between 1915 and 1918. They sold the old
home place in 1918 and in 1919 bought a farm on Woodpecker
Road Matoaca, Chesterfield, VA. He wanted to move his girls
closer to Petersburg high school, so they later bought a combination
store and home in Ettrick, VA. In addition he owned a blacksmith
shop, a wood/coal business and drove a school bus.

Davis 1858; married Mary Dalton Foster
(see #3), daughter of Abram Penn Foster and
Mary Jane Critz, 4/2/1868; died 1/24/1914 at
Ridgeway, Henry, VA, at age 82; Newspaper Obituary: Mr. John
H. Burgess, one of Henry county's oldest and most respected
citizens and one of her most fearless, faithful Confederate
soldiers, answered the last "roll call" about 2
o'clock, at his home near Ridgeway, aged eighty-three years.
He was a man of great energy and ability, a soldier without
fear, a citizen loyal to his country, a friend faithful and
true. His long and useful life was lived simply and unostentatiously,
but the strength of his convictions and earnestness of purpose
made its impress upon all who came within the circle of his
acquaintance. He was a zealous, consistent member of the Primitive
Baptist church, and one of its most liberal supporters. Mr.
Burgess is survived by his wife, who was a Miss Foster of
Patrick county and eleven children, Mrs. Bennett, of NC; Miss
Elizabeth Burgess and Mrs. H. B. Wharton, of Roanoke, Mr.
Foster Burgess, of Clifton Forge; Messrs. Joe, Robert, and
Herbert and Miss Posey, of West Virginia; Mrs. Dr. Strong,
of Dakota, Mrs. Jas. McDonald, of FL and Mr. John A. Burgess,
of Henry County; buried after 1/24/1914 at John H. Burgess
Cemetery, Burgess Creek, Henry, VA.
Estate settlement: John H with estate of Othineal Minter
balance due of 1776.14 to John H. Burgess by young Mr. Burgess.
Used Dr. John H. Burgess in initial sentence on 4/9/1849 at
Henry, VA. He was educated circa 1850 at Roanoke, VA; Pre-law
at Hollins Colledge then known as Valley Union Seminary. Based
on this he consulted with friends and neighbors on legal maters.
He had estate inventory recorded 5/10/1853 Burgess Creek,
Henry, VA, Lucy Estate (from husband) paid John Burgess $6.00.
Mary D with husband William S. Minter deed two tracks of land
to John H. Burgess for $293.75. #1 of 37.5 acres lying on
Marrowbone Creek bounded by ... John H. Burgess on East. #2
Coalman Wills on S., Tolly Minter on W., the dower land of
Lucy Burgess on E. on Marrowbone and Bouldins Creek circa
1855. He began military service circa 1861 Enlisted as a Sergeant
1st Class on 08 June 1861 in Ridgeway in Company A, 42nd Infantry
Regiment Virginia. Promoted to Full Lieutenant 1st Class on
15 September 1861. Dropped from the rolls on 21 April 1862.
His regiment fought as follows: 11 September 1861 at Mingo
Flats, VA; 20 March 1862 at Winchester, VA; 23 March 1862
at Kernstown, VA. Was excused to go home and as a justice
of the piece was required to arrest dissenters. Had one close
call when he shot 3 and was not killed because one dissenter's
gun misfired. When his office as magistrate expired he returned
to active duty around Petersburg. Served until Lee surrendered.
His final rank was Captain. He was organizer and preacher
of a primitive Baptist church until it was well established
and could employ a professional minister. His almost religious
fanaticism was attributed to his war experience. He ended
military service in 1865; At end of Civil War. He lived in
1868 at Burgess Creek, Henry, VA; Later called the Old Home
Place. Mary Foster Burgess was postmistress among other duties.
Rugulis is family tradition name for the family plantation.
Location was on Burgess Creek SE of Martinsville, VA. (Note:
Family tradition is that at the end of war he provided all
of his freed slaves with an acre of land. His former slave
John and his wife remained at the home place for many years.
Each family report on visits back to the home place met with
John. Supposedly, when young, John went with John Henry to
visit a neighboring plantation and John pointed out a female
slave that interested him. John Henry then purchased the slave
girl who became John's wife. John accompanied John Henry on
his Civil war duty. John is seen in a number of family photos.
Though we are now very ashamed that our ancestors supported
slavery, it is some comfort to have evidence of kind treatment
of slaves).

(Note: His father, John Henry loved the land and wanted
his sons to be farmers. According to Cherie Burgess, John
Henry tried to get Foster to marry Betsy the daughter
of a well to-do farmer in the area name, but he left home
before the plans could be carried out. His first job was
coal mining. Later worked with H. Bernard Wharton in nursery
business and lived at Happy Hallow. He married Aunt Minnie
and they adopted Agnes. Agnes married a Yates who left
after they had two sons, Lee and Foster. Lee spent a week
during summers at Yellow House during the 1950s. Agnes
worked for NASA and lived in Hampton, VA).

4/19/1870; died 1924; buried 1924 at Bluefield, WV.
As of 4/19/1870, she was also known as Sister
BURGESS. As of 4/19/1870, she also went by the
name of Lizzie BURGESS. She was educated
in 1890; Music education. Taught school in Roanoke VA.
She lived circa 1920 at Boston, MA. (Note: She taught
John Abe to play a guitar. She became very ill with what
was believed to be cancer. After a failed operation she
was diagnosed to have a terminal illness. She was given
a Christian Science Sentinel, which she read and was apparently
totally healed. Most of her siblings converted to Christian
Scientist based on this experience).

married Nannie Tyree 10/10/1906; married Mary
Douthat 2/12/1929; died 5/5/1962 at Fort Lauderdale,
FL, at age 90; buried after 5/5/1962 at Bluefield, WV.
As of / /1871, he was also known as Robert BURGESS.
He lived circa 1900 at Bluefield, WV. (Note: Named after
Father's hero General Robert. E. Lee. Had daughter named
Foottie. Second wife Mary was his Secretary. Went to night
school and obtained a certificate in business and electrical
wiring, which enabled him to have a successful electrical
contracting business. He vacationed in FL).

5/18/1912; died 1939; buried 1939 at Bluefield, WV.
As of 4/18/1874, she also went by the name of Janie
BURGESS.

born 1/3/1876; married Dr. Thomas Jefferson
Strong 7/7/1910; Met while homesteading in Montana;
died 1964 at Richmond, VA.
(Note: She and sister Jane obtained a nursing certificate
in a Philadelphia, PA hospital c1895. They then went homesteading
in Montana c1905. Lottie spent her last years starting
c1955 in the Daughters of the Confederacy Home in Richmond,
VA. From there, she would visit the Yellow House Farm
on special occasions. She previously lived for a period
with her sister Ellen at Happy Hollow).

- vii. Ellen Cabell; born 2/20/1880;
married Henery Bernard Wharton 8/9/1906; died
9/8/1981 at Salem, VA, at age 101; buried 9/9/1981 at Sherwood
Memorial Cemetery, Lot 212, Section 11, Salem, VA.
She was educated circa 1900 at Farmville, VA; Obtained
teaching certificate. Later taught in Covington where
she met H. Bernard Wharton. She lived after 1908 at Happy
Hollow, Salem, Roanoke, VA; She loved nature and would
hold classes for her nephews, nieces and neighborhood
children to teach the names of birds and flowers. (Note:
"Aunt" Ellen and "Uncle" Bernard hosted
many family gatherings at Happy Hollow. After John Henry
died and the Old Home Place on Burgess Creek was sold
Happy Hollow became the summer home for "Great-Grandmother"
Mary Foster Burgess. It became the substitute "Home
Place". Its beautiful mountainside location attracted
Ellen's niece Cherie Burgess Shindell and her husband
to build on adjacent property. Bernard owned a very successful
nursery business in Salem. He used Happy Hollow to grow
nursery plants so its grounds became a large garden. They
spent each winter in Florida. Soon after Bernard died,
Ellen moved into a nursing home in Salem were she remained
for the remainder of her long life. She gave the Happy
Hollow home to her unmarried niece Mary Jane Burgess and
divided the property between Cherie and Mary Jane. The
nieces eventually gave Happy Hollow to Roanoke County
for its use as a county park).

Seaborn circa 1945; married an unknown person circa
1955 at Roanoke, VA; died 10/22/1969 at VA Mental Health

1045 Lynchburg Turnpike, Sherwood Memorial Cemetery, Lot
212, Section 11, Salem, VA.
As of 9/14/1885, he was also known as Pete BURGESS.
He was educated circa 1905 at VA Tech, Blacksburg, Montgomery,
VA; Had financial support from three brothers. He was
Sales manager for Hagerstown Shoe and Legging Co. Eventually
had a district in FL where he lived for many years circa
1910 at St Augustine, FL. He lived circa 1930 at Airheart,
Roanoke, VA; Worked for Gas Company and Bernard Wharton's
nursery. (Note: He was very outgoing and friendly, a natural
salesman. However, he had a mental health problem that
resulted in several confinements in the Virginia mental
hospital in Stanton. Was committed by sister Posye in
c1940 when he became a danger to himself and others. Problem
was with illusions).

at Happy Hollow, Salem, Roanoke, VA; Met while serving as
nurse for his father; died 4/17/1970 at Roanoke, VA, at
age 81.
She was RN circa 1908. She lived after 1922 at Roanoke,
VA. (Note: "Aunt" Poyse lived in downtown Roanoke.
She had a very bubbly personality. She and her sister
Ellen took turns caring for their mother Mary Foster Burgess
in their homes. Poyse always hosted her mother in the
winters when Ellen was in Florida. "Great-Grandmother"
Burgess died at the lunch table in Poyse's home).
3. Mary Dalton2
FOSTER (Abram, #6); born 5/16/1844;
married John Henry Burgess (see #2), son of
John Burgess III and Polly Weaver,
4/2/1868; died 12/1/1943 at age 99; Day of month is unknown.
Was active and alert with deafness being her only problem.
She told her daughter Posye that she was tired and set down
at the lunch table and died; buried after 12/1/1943 at Bluefield,
WV.
She lived on 4/10/1868 at Burgess Creek, Henry, VA. She
was Member of DAR in 1936. (Note: Her Granddaughter Cherie's
Autobiography relates the following story: "They went
to one of the fashionable spas for their honeymoon. As they
walked up the steps, one of the elderly men sitting in the
rockers on the porch turned to another and remarked, well,
it will be the widow Burgess this time." Cherie went
on to say: "He was so right as she bore John Henry ten
children and reared them all plus the two stepdaughters from
his second marriage as well as a step-granddaughter (Ruth's
infant daughter Elizabeth until her father married again).
She survived him by 29 years. At the age of 90, she proclaimed
that she thought she had done her part."
Research has found no link between her Dalton ancestors and
the Dalton outlaw gang, contrary to some rumors).

BURGESS III (Davis, #8);
born circa 4/7/1800 at Burgess Creek, Henry, VA; married Polly
Weaver (see #5), daughter of John Weaver
and Mary Weaver, 10/22/1825 at Henry, VA; Witnessed
by Benjamin Weaver. Marriage performed by Othniel Minter;
died 10/10/1836 at Burgess Creek, Henry, VA; Date defined
by will pronouncement. Cherie Shindell documented that he
died of a fever, and because of a fear of spreading his disease;
the house and all of its contents were burned, including all
family records and heirlooms.
Davis Burgess deeded 100 acres N. of Smith River to John
Burgess on 6/16/1828 at Henry, VA. He left a will on 1/4/1830
at Burgess Creek, Henry, VA; Dispersal as follows: (1) Cover
debts. (2) One-third to wife Polly Burgess during her life.
(3) Two-thirds to infant daughters Elizabeth and Mary D and
other children divided equally and given at lawful age. (4)
On wife's death her part divided equally to children. Executers:
Dartelon King and George Harrison. Witnesses: Gideon Crews
(?sp.), Benjamin Weaver and James C. Weaver. Estate settlement:

during her widowhood, for a certain track of land situated
in Newberry Township, York PA ... 100 acres on 5/5/1770 at
York, PA. He began military service circa 1776 at VA Capt.
in Revolutionary War. He and Mark Foster took
Oath of allegiance in 1777 at Henry, VA. He was served in

Thomas Gabriel and James Edward Tatum in 1872 at Spoon Creek,

births; died 7/28/1806 at Burgess Creek, Henry, VA.
(Note: He is the earliest Burgess found in our line. His
earliest record was his marriage to Mary Davis in Kingston
Parish VA (Now Mathews County). In that area, records of colonial
Gloucester of 1639 list a John Burgis as one of 60 persons

she was surely William's wife. John's wife was probably named
for her. On May 31, 1669, William Newsom and Thomas Warren
witnessed a document together, which indicates that they were
