In the name of God amen the 14th day of November in the year
of our Lord 1805, I John Burgess of the county of Henry being
in a low state of health in body but of perfect mind and memory
thanks be given to God for the same and calling to mind the
mortality of my body and knowing that it is appointed for
all men once to die do make and ordain this my last will and
testament that is to say principally and first of all give
and recommend my soul unto the hands of God that gave it and
for my body I recommend it to the earth to be buried in a
Christian and decent manner at the direction of my executor
nothing doubting but at the corporeal resurrection I shall
receive the same again by the mighty power of God and as touching
such worldly estate therewith it hath pleased God to bless
me with in this life, I give devise & dispose of the same
in manner and form following that is to say in the first place
I give and bequeathed to my son Davis Burgess the sum of one
dollar good and lawful money of the United States to him and
his heirs forever. Item I give to my daughter Elizabeth Hewlett
the sum of one dollar like money to her and her heirs forever.
Item I give to Edward D. Hewlett the sum of ten pounds of
like money to him and his heirs forever. Item I give to Polly
M. Hewlett the sum of ten pounds of like money to her and
her heirs forever. Item I give to Nancy D. Hewlett the sum
of ten pounds of like money to her and her heirs forever,
Item I give and bequeathed to my daughter Mary A. Burgess
one horse and saddle one cow and calf and one feather bed
and furniture to her and her heirs forever, it is also my
wish an desire that the said Mary A. Burgess shall live on
my land that I shall hereafter dispose of so long as she shall
live as a single woman. Item I lend to my beloved wife Mary
Burgess during her natural life and widowhood all my estate
both real and personal, stock of all kind, household furniture
viz that has not been heretofore mentioned Item I give and
bequeathed to my son?John Burgess all my estate so lent to
my wife Mary whenever she dies or marries, to him and his
heirs forever, and lastly I make and ordain the said John
Burgess my only and sole executor of this my last will and
testament. In witness whereof I have hereunto set my hand

In the name of God men, I Davis Burgess of the county of
Henry being of sound mind and wishing to make a disposition
of my worldly goods do make this my last will and testament
hereby revoking all others. Whereas I have heretofore given
to some of my children a part of my estate by way of advancement
to wit to my daughter Elizabeth Hefflefinger I have given
a bed and a sow and pigs a cow half, a side saddle worth about
thirty dollars to my daughter Sally Harrison a side saddle
and one feather bed and 1 cow & yearling mounting to forty
three dollars, to my daughter Polly Potts one feather bed
mounting to fourteen dollars, to my son Hewlett Burgess I
have given one bed one cow and calf one sow & pigs, one
horse amounting seventy nine dollars also one tract of land
containing one hundred acres worth two hundred dollars in
all mounting to two hundred and seventy nine. To my son Thomas
I have given a horse mounting to thirty dollars. To my wife
Lucy Burgess I give during her life my tract of land lying
on the south aide of Smiths river containing one hundred &
forty acres, one negro man named Tilman two apprentices which
were bound to me, David Man & Reuben Ban, one feather
bed & furniture whichever she may choose horses also all
my stock of cattle & hogs also my stock of sheep. It is
also my will & desire that my two daughters Milly &
Nancy whilst they are single live with their mother and be
supported out of the property herein before bequeathed to
my wife to my daughter Milly I give one feather bed &
furniture, to my daughter Nancy I give one feather bed and
furniture I give and bequeath to my son John Burgess one hundred
acres of land lying on the north side of Smiths river to be
laid off as follows to wit Beginning at Martins Cobler's corner-line
on the river thence with Cobler's line in easterly course
to his corner thence continuing the same course to my back
line thence with said back line a sufficient distance that
by running a parallel line with Cobler line to the river will
include the quantity. I also give to my son John one feather
bed & furniture. To my son Thomas Burgess I give also
one hundred acres to begin at whence John Burgess's lower
line will strike the River, thence an easterly course with
said John's line to my back-line thence with said back line
a sufficient distance as by running a line parallel with said
John's lower line to the river will make the quantity I also
give to my son Thomas one feather bed & furniture. It
is my will and desire that my unfortunate son William shall
be maintained by his mother of my estate left to her as before
mentioned
It is my will & desire that my executors herein after
named shall sell my negro woman named Lise and tier child
major & my crop of tobacco and to collect whatsoever debts
are due me & from the proceeds thereof to pay all my just
debts and whatever over plus to divide equally amongst my
daughters the land stock of cattle, horses, sheep, hogs &
all my household and kitchen furniture after the death of
my said wife Lucy Burgess I will and desire shall be divided
amongst all my daughters as shall with the advancements severally
made to them make them equal after a sufficient maintenance
shall be made for my son William if he should out life his
mother I have already given to my son John Burgess one horse
worth forty dollars. As there will be a balance of land lying
on the north side of the river undisposed of I will &
desire that my executors value the said land & offer it
to either of my sons and whichever of them takes it at the
valuation shall pay the mount to my sons in such proportion
as shall make all their parts equal with each other??I appoint
my friends Nathaniel W. Dandridge, James E. Bouldin &
my wife Lucy Burgess my executors In return whereof I hereunto
set my hand & seal this 22nd day of February 1828. Signed

John Burgess (III) - Will Abstract 4 Jan
1830
Dispersal as follows: (1) Cover debts. (2) One-third to wife
Polly Burgess during her life. (3) Two-thirds to infant daughters
Elizabeth and Mary D and other children divided equally and
given at lawful age. (4) On wife's death her part divided
equally to children. Executers: Dartelon King and George Harrison.
Witnesses: Gideon Crews (?sp.), Benjamin Weaver and James
C. Weaver.
John H. (Henry) Burgess - Deed Jan 1910
THIS DEED made this January ____ 1910, between John H. Burgess
and Mary D. Burgess his wife, parties of the first part and
John A. Burgess party of the second part, WHITNESSETH: that
the said parties of the first part, for a valuable consideration,
subject to the terms and conditions herein expressed, both
hereby grant, deed, and convey with general warranty of title
unto the said party of the second part, a certain tract or
parcel of land lying and being in the County of Henry and
State of Virginia, about 3-1/2 miles East of the town of Ridgeway,
which includes the home house of said John H. Burgess and
all of the tract known as the Polly Burgess dower, and all
of the land lying South of the public road leading from Long
Island Ford road to the bridge at the mouth of Marrowbone
Creek where it empties into Smith's River, on the conditions
that the said John A. Burgess and his wife Florence B. Burgess,
are to remain with, provide for and take care of said John
H. Burgess and Mary D. Burgess during the terms of their natural
life, and said home house hereby conveyed is to be the house
of single daughters of said John H. and Mary D. Burgess so
long as said daughters shall remain unmarried and so desire
and neither of the parties to this deed shall be responsible
for any debts contracted by the other, unless expressly consented
to by the part to be so charges. Witness the following signatures
and seals this the day and year first above written.

J.A. Burgess et als.
This DEED, made this the 19th day of January, 1918, between
John A. Burgess and Florence L. Burgess, his wife, Mary F.
Burgess, H. Elizabeth Burgess and Posey L. Burgess, parties
of the first part and J.H. Hardy in consideration of the sum
$2500.00 (twenty five hundred dollars) all of which to be
paid in annual installments, seven of which for $300.00 each
and one for $400.00 each evidenced by notes, bearing made
on the 1st day of January, 1918 due and payable to John A.
Burgess in one, two, three, four, five, six, seven, and eight
years from the date thereof, none of which notes to bear interest
until the expiration of two years from date of same, at which
time each one is to bear interest until at the rate of six
per cent per annum, the parties of the first part doth hereby.
Bargain, and sell, grant and covey unto the party of the second
part, in fee-simple with general warranty of title, that certain
boundary or tract of land, lying and being in the County of
Henry, Virginia, in the Ridgeway district, on the waters of
Bouldin's {now Burgess} creek, know as a part of the John
H. Burgess tract, containing one hundred and three acres,
more or less, and described and bounded as follows: - BEGINNING
at a stake on a road leading to Marrow Bone Bridge {Route
642?} thence with the road S.53 "1/2 E.42 poles to a
bend, thence off S.80 E22 poles crossing said creek to a poplar;
thence with Hardin Burgess's line S.8 W.23 poles to a pine;
N 62 W.199 "1/2 poles to a sassafras near a small branch;
thence down a hollow and said branch N.84 poles crossing said
creek to a rock, N.38 "1/2 E.114 poles to a stake in
a field, N.6 W.13 poles to a said Marrowbone bridge road;
thence with the road S.53 E.16 poles, S.79 E. poles, leaving
said road at 28 poles and with a plantation road to a corner
in Robert Burgess's line, S.40 W.40 poles to the beginning.
It being the same land conveyed to said parties of the first
part by John H. Burgess in deed recorded in Henry County Circuit
Court Clerk's Office to which deed reference is hereby made
for a particular description. And the parties of the first
part do hereby expressly reserve their vendor's lien on the
land herein conveyed all the purchase money together with
interest is fully paid. Witness the following signatures and
seals the day and year first above written:
